The creators of this site have tried to keep the content accessible and usable for as wide an audience as possible.

Size of text

Increasing or decreasing the size of the text is possible in all popular web browsers by holding the Ctrl key (on OS X operating systems the Cmd key) and pushing either “+” or “-” key at the same time. Another convenient approach is to use the mouse by holding the Ctrl/Cmd key while moving the mouse’s scrolling wheel. The regular size of the website can be restored by pushing the Ctrl/Cmd key and “0” key at the same time.

 

Terms of sale of the online shop

The online shop pood.tartmus.ee (hereinafter Online Shop) is owned by the Tartu Art Museum, 70004366, Rüütli 21, Tartu.

The validity of the contract of sale, and information about products and prices

The terms of sale and the valid price-list of the Online Shop are available on the website of the Tartu Art Museum Online Shop.
The terms of sale apply when products are purchased from the Online Shop.
The prices of the products which are on sale in the Online Shop are listed beside them. An additional charge for delivering the products will be added. All of the prices of the products which are on sale in the Online Shop are in euros.
The charge for delivering products depends on the location of the buyer and the desired method of delivery.
The charge for delivery will be displayed to the buyer when the order is finalised.
Information about the products in the Online Shop is presented immediately next to the products.

Finalising the order

To order products, the desired product must be added to the shopping basket. To finalise the order, the required form fields have to be filled in and the desired method of delivery must be selected. After this, the total cost is displayed, which can be securely paid using various forms of payment. When a bank transaction is used, “Return to the seller” must be clicked on the bank’s website. The payments go through Maksekeskus AS. Paying takes place outside the Online Shop in a secure environment: in the bank’s own secure environment when using a bank transaction and in the secure environment of Maksekeskus AS if using a credit card. The seller does not have any access to the bank and credit card information of the client. The contract becomes valid only after the required sum is deposited in the bank account of the Online Shop.
The owner of the online shop is the controller of the personal data and forwards the personal data necessary for the execution of payments to the processor, Maksekeskus AS.
If the ordered products cannot be delivered due to being out of stock or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded no later than 14 days after the notification.

Delivery

Products are shipped to the following countries: Estonia, Latvia, Lithuania and Finland.
The buyer has the following options for delivery of the products: Smartpost, DPD or picking up the products themselves.
The shipping costs are borne by the buyer and the corresponding price information is displayed alongside the shipping method.
In Estonia, domestic shipments will generally arrive at the destination specified by the buyer within 7 working days from the entry into force of the sales contract. Outside Estonia, delivery will take place within 14 calendar days.
In exceptional cases, the products may be delivered within 45 calendar days.

Right of withdrawal

After receipt of the order, the buyer has the right to withdraw from the contract concluded in the Online Shop within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
In order to exercise the right of withdrawal within 14 days, the products ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the products, in the same way as is allowed for testing products in a physical shop.
If the products have been used for purposes other than what is necessary to ascertain the nature, characteristics and functioning of the products, or if the products show signs of use or wear, the Online Shop has the right to reduce the refund in accordance with the reduction in the value of the products. In the event that the ordered product has been used or damaged, the Tartu Art Museum shall be entitled to claim compensation for the loss up to the selling price of the product, depending on the loss in value of the product. The corresponding amount shall be deducted from the amount to be refunded to the customer.
In order to return the products, a withdrawal form must be submitted, stating the order number, the first name and surname of the customer, the bank account number of the customer and the name of the account holder, and sent to within 14 days of receipt of the products.
The cost of returning the products is borne by the buyer, unless the reason for the return is that the product does not correspond to the product ordered (i.e. wrong or defective product).
The buyer must return the product within 14 days of the date of the application or provide proof that they have handed it over to the carrier within the aforementioned period.
Upon receipt of the returned product, the online shop will return to the buyer no later than 14 days after receipt of the withdrawal all payments received from the buyer under the contract.
The online shop may refuse to offer refunds until the return of the product that is the subject of the contract or until the buyer has provided proof that they have returned the product, whichever comes first.

If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.
The Online Shop has the right to withdraw from the sale and to demand the return of the product from the buyer if the price of the product in the Online Shop has been marked significantly below the market price due to a mistake.

Return by DPD

DPD offers a PIN return service. Upon receipt of the parcel, the customer will be informed of the possibility of return by SMS and/or e-mail. The message or e-mail will contain the PIN and/or QR code required for the return. By using the PIN and/or QR code, the customer can print the return label at the parcel machine and return the parcel.

The customer brings the products to the Tartmus Museum Shop himself or herself

We ask you to fill in a withdrawal form and return the product with the invoice. It is also possible to fill in the return form at the Tartmus Museum Shop.

Return by Smartpost

If the parcel arrived at a blue parcel terminal, it can be returned free of charge with the same door code if the business customer (sender) has the return service activated. If you have received a parcel in a white parcel terminal and you wish to return the parcel, go to the Smart self-service environment my.smartpost.ee to make the return. Right to lodge a complaint

The customer has the right to submit complaints about the product within the time period stipulated in the legislation of the Republic of Estonia pertaining to the Tartu Art Museum at the e-mail address epood@tartmus.ee.
In the event of a defect, the buyer has the right to contact the Online Shop within two months by sending an e-mail to epood@tartmus.ee. The Online Shop shall not be liable for damage occurring after delivery of the product to the buyer.
If the product purchased from the Online Shop has defects for which the Online Shop is responsible, the Online Shop will repair or replace the defective product. If it is not possible to repair or replace the product, the Online shop will fully reimburse the buyer according to the sales contract.
The Online Shop will respond to a complaint submitted by the consumer in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The Online Shop uses the personal data provided by the buyer only for the purpose of processing the order and sending the product to the buyer. The Online Shop transfers personal data to companies providing transport services in order to deliver the product.
The Online Shop sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish to receive them by entering their e-mail address on the website and has indicated their wish to receive direct mail notifications.
The buyer may opt out of receiving offers and newsletters by e-mail at any time by notifying the Online Shop by e-mail or by following the instructions in the e-mail containing the offers.

Resolving disputes

If the buyer has any complaints about the Online Shop, they should be sent by e-mail to epood@tartmus.ee.
If the buyer and the Online Shop are unable to resolve a dispute, the buyer can refer the matter to the Consumer Disputes Committee. You can read the terms and conditions of the procedure and submit an application here. The Consumer Disputes Committee is competent to settle disputes arising out of a contract concluded between a buyer and the Online Shop. The examination of the buyer’s complaint by the Committee is free of charge.
The buyer may also refer the matter to the European Union’s consumer dispute resolution platform.
